Terms of Service

Language. This document is currently provided in English only. The English version is the legally binding text. Translations into Dutch, German, French, Italian, Spanish, Portuguese, and Japanese can be requested at hello@tracksensei.com and are provided for convenience without altering the binding English original. These Terms of Service ("Terms") govern your use of TrackSensei at tracksensei.com. By creating an account or using the service, you agree to these Terms.

1. The Service

TrackSensei is an AI-powered music production analysis tool. You select audio files (analyzed entirely in your browser — no server upload) and/or upload Ableton Live project files (.als), and receive automated analysis reports with AI-driven feedback on your production. The service is offered as-is and is intended as a learning and feedback tool — not as a substitute for professional audio engineering.

2. Accounts

You must provide a valid email address to create an account. You are responsible for keeping your login credentials secure. You must not share your account with others or create multiple accounts to circumvent usage limits. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscription Tiers

TrackSensei offers three tiers: Free, Pro, and Unlimited. Each tier has specific limits on the number of analyses per month and chat messages per analysis. Current pricing and limits are displayed on our pricing page. We may adjust pricing with 30 days' advance notice to active subscribers.

4. Payments and Refunds

Paid subscriptions are billed monthly through Stripe. You can cancel your subscription at any time through your dashboard — cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial months. If you experience a technical issue that prevents you from using the service, contact us and we'll work with you on a case-by-case basis.

4a. Currency and Pricing

Prices are displayed and charged in the visitor's local currency where supported. Today this includes the Euro (EUR) for the eurozone and the British Pound (GBP) for the United Kingdom; additional currencies will be added as the service expands. Visitors located outside a supported region see prices in EUR, and Stripe converts the EUR amount to their local currency at checkout using the prevailing mid-market exchange rate plus any conversion fees applied by their bank or card issuer. The currency shown on the Stripe Checkout page is the currency the customer's card will be charged in. VAT or equivalent sales tax is calculated automatically based on the billing address provided at checkout.

4b. Booster Top-ups (Ultimate only)

Boosters are one-time purchases of additional AI tokens, available exclusively to Ultimate subscribers. Three sizes are offered: Booster S (250,000 tokens), Booster M (500,000 tokens), and Booster L (1,000,000 tokens). The exact prices in your currency are displayed at checkout (for reference: EUR pricing is €15 / €30 / €60; GBP pricing is £13 / £26 / £49). All amounts include applicable VAT.

Booster tokens do not expire and are consumed only after your monthly Ultimate budget is exhausted, ensuring you always burn the lower-cost subscription rate first.

Right of withdrawal — Article 16(m) Consumer Rights Directive. Booster tokens are digital content delivered immediately upon successful payment. Before completing the purchase, you must explicitly acknowledge and waive your statutory 14-day right of withdrawal. By ticking the refund-waiver checkbox at checkout, you confirm that:

Discretionary refund window. Outside the statutory framework, we will consider refund requests submitted within 14 days of purchase only if you can demonstrate that no Booster tokens have been consumed since purchase (i.e. your token balance is unchanged). Contact support@tracksensei.com with the relevant payment reference. A granted refund will reverse the token credit (clamped at zero — your balance never goes negative).

Booster purchases are not available to Free or Pro subscribers; the option appears only when your account holds an active Ultimate subscription (or a promotional Ultimate tier).

5. Your Content

You retain full ownership of all audio files, project files, and other content you submit to TrackSensei. We do not claim any rights to your music or productions.

Audio files are analyzed entirely in your browser — they are never uploaded to our servers, and we therefore never possess a copy of your audio. Only the numerical analysis metrics computed client-side are transmitted to us.

Reference track feature data. When you upload a reference track for a Deep Dive comparison, you grant TrackSensei a non-exclusive, worldwide, royalty-free license to derive and store anonymized numerical feature data from that track (LUFS, frequency balance, stereo metrics, kick design descriptors, and similar technical descriptors as detailed in our Privacy Policy) for the purpose of improving the calibration of the analysis tool. This license expressly excludes the audio file itself, the filename, embedded audio metadata, and any content from which the original recording could be reconstructed — none of which we receive or store. You may revoke this license at any time by deleting your account or by emailing privacy@tracksensei.com; aggregated calibration targets derived prior to revocation remain in effect, but the underlying feature vectors associated with you will be removed or anonymized within 30 days. See Section 5 of our Privacy Policy for retention details.

Reference sets (May 2026 onward). You may also save named collections of reference tracks to your profile ("reference sets") and choose to score your own uploads against your set instead of the generic genre baseline. Each track you add to a set is analyzed in your browser exactly like your own uploads: the audio file never leaves your device, and only the resulting numerical feature dictionary (typically 5–50 KB of JSON, containing no identifiable audio content, no filename, and no embedded metadata) plus the display name you choose are transmitted to and stored by TrackSensei. Reference sets are:

By adding a track to a reference set, you confirm that you have the right to do so for personal analytic purposes (own production, licensed material, or fair-use reference comparison under your local law). You retain all copyright in the underlying recording.

Ableton project files (.als) are uploaded to our servers for parsing. By uploading a .als file, you grant us a limited license to parse it in memory for the purpose of delivering the analysis service. The .als file itself is discarded immediately after parsing — only the extracted metadata (tracks, plugins, arrangement, etc.) is retained as part of your analysis report.

Analysis reports, production scores, generated visualizations, and chat history are retained for 30 days so you can revisit them, then permanently deleted.

6. Acceptable Use

Reference tracks and reference sets. You may upload third-party copyrighted material solely as a reference for comparison against your own work — both as a one-off Deep Dive reference track and as part of a saved reference set on your profile. In both cases the audio is analyzed in your browser and the audio file itself is never transmitted to our servers, redistributed, or used to train any model. The resulting numerical feature vector is sent to our server: for Deep Dive references it may be retained in anonymized form for calibration purposes (Section 5); for reference sets it is stored privately under your account until you delete it. Because that data contains no audio content and no identifying metadata, it does not reproduce the original recording in any form. You remain responsible for ensuring your reference use complies with local fair-use, study, or research exceptions.

7. AI-Generated Feedback

The production feedback provided by TrackSensei is generated by AI (Anthropic Claude). While we strive for accuracy and usefulness, AI-generated content may contain errors, subjective opinions, or suggestions that don't apply to your specific artistic intent. The feedback is meant as guidance, not authoritative instruction. Use your own creative judgment.

8. Force Majeure

Neither party shall be liable for any failure or delay in performing its obligations under these Terms to the extent such failure or delay is caused by events or circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, wars, terrorism, pandemics, government actions, cyber-attacks, strikes, or infrastructure failures. During force majeure events, we will make reasonable efforts to resume service promptly. If a force majeure event prevents service for more than 30 consecutive days, either party may terminate these Terms upon written notice.

9. Availability and Limitations

We aim for high availability but do not guarantee 100% uptime. The service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control. We are not liable for any losses resulting from service downtime except where such downtime is not caused by force majeure and exceeds the liability limitations in Section 10.

10. Limitation of Liability

TrackSensei is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

You may delete your account at any time. We may terminate or suspend your access if you violate these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of significant changes via email at least 14 days before they take effect. Continued use of the service after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved by the competent courts in the Netherlands.
